Accessory Circus would not be held responsible for the delay of goods or non-delivery of the goods due to conflict, strike, riot quake, flood, fire and other Force majeure causes agreed by both parties. However, Accessory Circus would advise the Buyers by e-mail or phone call, as soon as we are aware of such incident and within 14 days. In addition, we would also send an acceptance certificate issued by the competent authorities of the place where the accident occurs as evidence to the Buyer if the need arises.
In such event, Accessory Circus, are obliged to take all compulsory measures to speed the delivery of the goods and services. If the late delivery exceeds 10 weeks, the Buyers shall have the right to cancel this Contract.
In a situation, where parties fail to settle dispute within 30 days after a dispute had occur, they both agree to submit such a dispute to the United Kingdom Office Of Ombudsman for arbitration which shall be conducted in accordance with the Ombudsman’s arbitration rules in effect at the time of applying for arbitration. The arbitral awards are final and binding upon both parties.
This Contract denotes the whole agreement between the parties and supersedes all preceding agreements and representations between them. If any endowment of this Agreement is held to be unenforceable for any reason, such provision shall be improved only to the extent necessary to make it enforceable and the other terms of this Agreement shall remain effective. The failure of Accessory Circus Ltd to act with respect to a breach of this agreement by you or others does not constitute a waiver and shall not limit Accessory Circus Ltd’s rights with respect to such breach or any subsequent breaches. This agreement shall be overseen by and construed under law without regard to conflicts of law provisions. Any action or proceeding arising out of or related to this agreement or your use of this Site must be taken to the English Law Courts and you agreement to the exclusive personal jurisdiction of such courts.
